David Stein

David Stein has over thirty years of civil litigation experience, including administrative and arbitration proceedings, trial and appellate work. His areas of expertise include: employment/compensation matters, with emphasis on restrictive covenants; commercial and partnership disputes; and Federal securities regulation and sales practice complaint matters. Prior to joining Moskowitz & Book, LLP, David was a partner in a boutique litigation practice focused on the financial services industry, General Counsel to a major New York City owner/developer/real estate manager, and a litigation associate at Stroock & Stroock & Lavan.

David graduated with an A.B. in History, magna cum laude, in 1979 from Brown University, where he was elected to Phi Beta Kappa. He is a 1982 graduate of the New York University School of Law, and served as Managing Editor of its Moot Court Board. A member of the New York State Bar since 1983, David is also admitted to practice before the United States District Courts for the Southern and Eastern Districts of New York, the Second Circuit U.S. Court of Appeals, and the Supreme Court of the United States.

Representative of David’s broad and successful litigation practice are the following reported decisions: Turner v. New York Rosbruch Harnik, Inc., 84 F. Supp.3d 161 (E.D.N.Y. 2015); Healy v. Merrill Lynch Pierce, Fenner & Smith, Inc., 2001 WL 1004175 (N.A.S.D.); National Union Fire Ins. Co. of Pittsburgh, Pa. v. Eagle Equipment Trust, 221 A.D.2d 212 (1st Dep’t 1995); Boley v. Pineloch Associates, Ltd., 700 F. Supp. 673 (S.D.N.Y. 1990); Matter of Tilles v. Williams, 119 A.D.2d 233 (2d Dep’t 1986); Hill v. Berkman, 635 F. Supp. 1228 (E.D.N.Y. 1986); and J.P. Realty Trust v. Public Service Mutual Ins. Co., 64 N.Y.2d 945 (1985).

He is an active member of the New York State Bar Association and the Association of the Bar of the City of New York. David has served as an Arbitrator of the Civil Court of the City of New York since 1993, and as FINRA Dispute Resolution Arbitrator.
